MAPCLUB Terms and Conditions

The website www.mapclub.com and/or the MAPCLUB application (the “Platform”) are owned and operated by PT MAPCLUB Digital Asia (“MAPCLUB” and “MAPCLUB Digital Asia'' collectively referred to as “we” or “us”). The terms and conditions of use for this Platform apply to all visitors and users of the Platform (“you”).

Please read these terms and conditions carefully, thoroughly, and in full before using our Platform services.

The terms and conditions set forth below constitute the terms of use for the Platform and will serve as an agreement between you and us. By accessing and/or using the Platform, purchasing products or services available or sold on the Platform (“Products''), or joining as a member (“Member”) of the MAPCLUB Customer Loyalty Program (“Program”), you acknowledge that you have understood, accepted, agreed to, and are bound by all the terms and conditions applicable to this Platform and Program, and you provide irrevocable consent to all such terms. If you do not agree with any part or all of these terms and conditions, you have the right not to access and/or use the Platform.

We reserve the right to replace, modify, suspend, or terminate all or any part of this Platform at any time or as required by applicable regulations.

1. Data Integrity

Unless we find otherwise, we consider all data and information you provide us through the Platform accurate and true. Therefore, you are responsible for updating or correcting that information and data if there are any changes.

2. Privacy Policy

You agree that all personal information and data that you transmit to us through the Platform, email, telephone, and other forms of communication can be collected, stored, and processed in accordance with our Privacy Policy. We reserve the right to modify or update our Privacy Policy at any time and to publish the updated version on the Platform. For more detailed information about our Privacy Policy, please refer to our Privacy Policy page.

3. Licenses, Trademarks, and Intellectual Property Rights

 

  • a. This Platform and all content, including but not limited to text, copy, themes, designs, illustrations, photos, artwork, and other content or materials (“Content”) contained within the Platform are owned by us, our licensors, or the content providers, and are protected by copyright, trademark, and other intellectual property laws of Indonesia and/or other countries (if applicable).
  • b. We do not grant or provide any rights or licenses to you. Use of the Platform does not imply or grant any rights or licenses to you.
  • c. We reserve the right to remove or stop displaying any Content on the Platform at any time, in accordance with our policies.
  • d. We strictly prohibit the misuse of Content on the Platform, including but not limited to:
    1. 1. Downloading, copying, or using Content or the Platform for the purpose of competing with the Platform, or for the benefit of vendors or third parties;
    2. 2. Modifying, distributing, disseminating, operating, publishing, uploading, licensing, manipulating, transferring, selling, or creating derivative works, of all Content or Products taken from the Platform;
    3. 3. Posting, uploading, or spreading any materials that contain software viruses or computer files, documents, or programs designed to disrupt, destroy, or limit the use of computer hardware or software, or to interfere with, disable, or collect information (such as system or personal data) from websites, including but not limited to scraping or data collection techniques, spider robots, or similar tools;
    4. 4. Taking any action that may cause or potentially cause excessive or unreasonable use or load, or disrupt the performance of the Platform infrastructure.
  • e. The trademarks, logos, and service marks displayed on the Platform are owned by us, our licensors, content providers, or other third parties. You are prohibited from using the trademarks and/or logos for any purpose, including using them on other websites without our written consent or the written consent of the third-party owner of the trademark and/or logo.
  • f. You are also prohibited from using framing techniques to include any Content on other websites and/or from using Content from the Platform or by using "text hidden" techniques without our prior written consent. All Content, including software and trademarks related to the Platform, is protected by copyright, trademark, and other applicable laws in Indonesia and/or other countries.

 

4. Objection

Except as expressly stated in these terms and conditions or as required by applicable law, we make no representations or warranties of any kind, express or implied, regarding anything, including but not limited to the Content and Products available on the Platform, the performance of the Platform, and/or the Products offered on the Platform.

You understand and agree that you use the Platform at your own risk. We reserve the right to limit or terminate your access to the Platform or any of its features at any time. We do not guarantee that there will be no interruptions or errors when accessing and using the Platform, that the Platform is secure, that it is free from viruses or other harmful components, or that the information on the Platform is accurate, truthful, timely, beneficial, reliable, complete, or correct.

Furthermore, any damage to your electronic system or loss of data caused by downloading Content from the Platform is your own risk.

5. Limitation of Liability

The providers of products and services available on the Platform are independent contractors, not our agents or employees. We act as a web portal service provider that facilitates your purchase of products available and sold on the Platform. We are not responsible for the actions, errors, omissions, statements, warranties, breaches, or damages, or any costs resulting from damages and/or losses caused by the products or any other damages.

You fully acknowledge, understand, and agree that the information you transmit or receive while you are a Member and/or user of the Platform is not completely secure and can be intercepted by authorized or unauthorized parties.

To the fullest extent permitted by law, we or our licensors, distributors, or third-party content providers shall not be liable or responsible for any loss, or damage (including but not limited to loss of money, reputation, profits, or other intangible losses) caused directly or indirectly by:

 

  • a. The Platform or website, application, or other source that you access through links from the Platform;
  • b. Actions we take or fail to take in connection with information or data you transmit to us;
  • c. Your membership on the Platform, including but not limited to termination or cancellation of membership;
  • d. Any products available or purchased from the Platform, including but not limited to injury, damage, or loss caused by use of the products;
  • e. Delays or inability to use the Platform, information, or products offered on the Platform;
  • f. Modification, violation, or deletion of any Content on the Platform;
  • g. Errors and losses caused by individual actions of Members;
  • h. Product quality;
  • i. Product delivery;
  • j. Intellectual property infringement;
  • k. Disputes between users or Members;
  • l. Damage to the reputation of third parties;
  • m. Misuse of products already purchased;
  • n. Viruses or other harmful software (such as bots, scripts, automation tools) due to accessing or connecting to the Platform;
  • o. Interference, bugs, errors, or inaccuracies in the Platform;
  • p. Hacking by third parties of user accounts or the Platform.

 

We or our licensors, distributors, or third-party content providers are not responsible for the behavior of Platform users.

6. Compensation

You are responsible and will indemnify us for any losses, as well as release us from any fines, penalties, obligations, and other damages arising from:

 

  • a. Your breach of these terms and conditions;
  • b. Your errors, misrepresentations, or negligence;
  • c. Your infringement of any third party's rights.

 

7. Electronic Communications

You agree that all agreements, notices, and other communications sent to you electronically are legally valid and are considered to have been sent and received by you when sent to the Communication Channel you have provided to us.

We may communicate with you through mail, email, phone, SMS, the Platform, Over the Top (OTT) services such as WhatsApp, Signal, Telegram, and other channels, or through social media and/or other digital/internet (“Communication Channels”). We may use these communication channels to inform you of the status of your Member account, notify you when you meet the requirements for a reward program, inform you of changes to the program, offer special promotions, provide information and offers that we believe may be of interest to you, and inform you of any other information that we deem necessary to communicate to you. We will always protect your data in accordance with applicable laws in Indonesia.

You may choose to stop receiving information from your chosen Communication Channel at any time, through the options available on the Platform.

8. Account

You must register with a password and provide certain personal information to access the Platform.

You may be able to use your account to access/purchase other products or services that we offer or that are provided by our partners. We are not responsible for the content, functionality, security, services, or privacy policies of the websites or services on those links.

You are responsible for protecting your login details, including your password. If you suspect that your login details have been misused or stolen, you must inform us immediately. Any communication we receive from the Communication Channel or your login account on the Platform is considered to be sent by you unless we receive notification from you stating otherwise.

You can delete or close your account by requesting the account deletion process in the application on the My Account menu. By ensuring that there are no unfinished transactions. Once an old account has been deleted, it cannot be activated or accessed again. All transaction data and MAPCLUB points obtained will be deleted and cannot be transferred.

9. MAPCLUB Loyalty Program

Membership Terms

 

  • a. If you do not have an account and/or are not registered as a Member, you will automatically be registered as a Member so that you can use and view your MAPCLUB Points.
  • b. We reserve the right to terminate the Program at any time for any reason.
  • c. Membership is only for individuals and not for companies, charities, partnerships, or other entities.
  • d. The Program can be joined by anyone who is at least 17 (seventeen) years old.
  • e. We reserve the right to suspend or terminate membership in the Program if:
    1. 1. You violate these terms and conditions;
    2. 2. You do not use the card and/or Program account within 24 months period;
    3. 3. You provide incomplete, inaccurate, false, or fictitious personal information;
    4. 4. You engage in fraudulent or illegal actions against us.
  • f. If we cancel or terminate membership for any reason, all MAPCLUB Points of the Member will expire.
  • g. Members are fully responsible for their membership information and account security.
  • h. Members can terminate the membership at any time on MAPCLUB application.

 

MAPCLUB Points Terms

You can earn MAPCLUB Points, which are customer loyalty points, by making certain transactions on our Platform or at participating offline stores (“Store) ("Earn MAPCLUB Points"). You can also use your MAPCLUB Points for certain purchases on our Platform and at participating stores ("Burn/Redeem MAPCLUB Points"). Click here to view a list of participating stores.

MAPCLUB Points have an expiration period with conditions validity for 12 (twelve) months from the date the MAPCLUB Points are earned by the Member, which will expire on the last day of the 12th month

MAPCLUB Member Level

 

MAPCLUB Level is the status of MAPCLUB members obtained through transactions that calculated based on the member’s accumulated spending over the past 12 months. The benefits of the MAPCLUB level are valid for up to 12 months from the date the latest level status is obtained.

T&Cs for Earn MAPCLUB Points for in-Store Transactions:

 

  • a. Members must inform the cashier at the store of their active and registered mobile number in the MAPCLUB Program before making a purchase to receive MAPCLUB Points.
  • b. Members must show their digital card from the MAPCLUB App to the cashier at the store before making a purchase for the use of MAPCLUB Points.
  • c. Members will receive MAPCLUB Points in an amount determined from time to time for each purchase made at the store. MAPCLUB Points are given based on the pre-tax and service charge clean price.
  • d. MAPCLUB Points will be added to the Member's account at a maximum of 2 (two) working days after the purchase transaction is complete.
  • e. MAPCLUB Points are not given for purchases made using vouchers.
  • f. For reason or technical issue that cause point not (delay) earned, Members may request for manual point earning by provide valid purchase receipt and reported to us no longer than 14 days since purchase date.

 

T&Cs for Earning MAPCLUB Points from Online Transactions (Platform):

 

  • a. Members must log in using their active and registered mobile number/email that is associated with the Program on the Platform before making a purchase to earn MAPCLUB Points.
  • b. Members will receive MAPCLUB Points for each purchase made on the Platform, in an amount that will be determined from time to time according to the Program's policies. MAPCLUB Points are given based on the pre-tax price and exclude shipping costs.
  • c. MAPCLUB Points will be added to the Member's account within a maximum of 2 business days after the product has been received, provided that there are no return or refund processes.
  • d. MAPCLUB Points cannot be given for purchases made using vouchers and/or for the purchase of certain products.

 

T&Cs for MAPCLUB Points Redemption (Burn/Redeem):

 

  • a. MAPCLUB Points cannot be used to make purchases with vouchers.
  • b. MAPCLUB Points cannot be exchanged for cash and are non-transferable.
  • c. MAPCLUB Points belonging to more than one Member cannot be combined to pay for a single transaction.
  • d. Once used, MAPCLUB Points will be promptly deducted from the Member's account.
  • e. If there is an error in the deduction of MAPCLUB Points by us, we will promptly return the deducted Points to the Member's account.

 

MAPCLUB Points Transfer (Gift Points) Terms & Conditions:

 

  • a. Members who have MAPCLUB Points can transfer Points to other Members as a gift. The transfer process involves the Member making a conversion transaction of the Points they wish to give away and entering the recipient's mobile number as the recipient of the Gift Points.
  • b. The recipient of the Points, who is not yet a MAPCLUB Member, will be automatically registered in MAPCLUB using the mobile number provided by the sender so that the recipient can view and use the Points they received by using the MAPCLUB App.
  • c. The mobile number entered as the recipient of the Gift Points is the sole responsibility of the sender of the Points. MAPCLUB is not responsible for any errors in data entry made by the sender.
  • d. The expiration date of the received Points will follow the expiration date of the original owner's Points.
  • e. The administrative fee charged is for the operational process and may change from time to time without notice.
  • f. MAPCLUB reserves the right to cancel the transfer of Gift Points if there is any misuse or violation of the applicable rules.

 

MAPCLUB Points Purchase Terms & Conditions (Points Buying):

 

  • a. Members can purchase MAPCLUB Points for their own account. The Points purchased can be used for shopping or sent to another person as a gift. The purchase of Points is made by entering the recipient's data and mobile number on the checkout page.
  • b. The maximum number of Points that can be purchased per transaction is 10,000,000 Points. The validity period of the purchased MAPCLUB Points is 12 months from the date of purchase.
  • c. The administrative fee charged includes the cost of the operational process and may change from time to time without notice.
  • d. MAPCLUB reserves the right to cancel the purchase and transfer of Points if there is any misuse or violation of the applicable rules.

 

10. Product Purchase Transactions

 

 

  • a. By making a purchase of Products, you agree that:
    1. i. You have read, understood, and agreed to all information/descriptions regarding the Products (including but not limited to color, quality, function, and others). By purchasing the Products, you are deemed to have understood and agreed to the aforementioned information/descriptions.
    2. ii. The color of the Products displayed on the Platform may vary, depending on your computer monitor and mobile device. We strive to ensure that the colors in the Product photos on the Platform are as accurate as possible, but we cannot guarantee that the displayed colors will be completely accurate.
  • b. You understand and agree that if there are any issues with fulfilling your order, including but not limited to stock availability, we reserve the right to cancel your order. In such cases, we will process a refund for the purchase of the affected Products.
  • c. Payment must be made promptly (within 12 hours for virtual account transfers) after you complete the checkout process. If payment is not made within this timeframe, we reserve the right to cancel the transaction. You are not entitled to make any claims or demands regarding the cancellation of the transaction.
  • d. You understand and agree that any delays in the payment process and/or additional fees that may arise due to differences in the bank used for purchasing the Products are your responsibility.
  • e. We may process a refund of your payment in the following cases:
    1. i. Overpayment for the Products;
    2. ii. Issues with the delivery of the Products, where the Products have been shipped by the store but not received by the buyer;
    3. iii. The store is unable to fulfill the order due to unavailability of the Products, changes in shipping costs, or other reasons;
    4. iv. The store fails to deliver the Products to you within the specified time frame;
    5. v. You request a refund due to errors in the delivery of the Products, resulting in the receipt of Products that do not match your order.
  • f. In the event of a refund, the refund amount will be adjusted according to the payment method used by you.
  • You agree not to disclose or share your proof of payment and/or payment details with any party other than MAPCLUB. In the event of any loss resulting from the disclosure or sharing of your proof of payment and/or payment details with any other party, you will be solely responsible for such loss.

 

 

11. Product Delivery & Insurance

Protection for Purchases at MAPCLUB, in collaboration with vendor (Insurance Brocker).

 

  • a. Benefits of the protection provided:
    1. i. Product replacement warranty up to the purchase price.
    2. ii. Faster digital claim process, as it is done through mobile.
  • b. Scope of Protection under Shipping Insurance and Product Damage Insurance :
    1. i. Physical damage that is unintentionally caused during the shipping process, such as falling or being damaged by liquid, resulting in the product being non-functional.
    2. ii. Loss due to theft during the shipping process, proven by material damage or injury to the body suffered by the courier.
    3. iii. Physical damage that is unintentionally caused during the policy period.
    4. iv. Loss due to theft during the policy period.
  • c. Terms & Conditions:
    1. 1. The buyer is required to make a video unboxing when opening the package. The video unboxing is required during the claim protection process (if there is a claim).
    2. 2. The buyer is required to check the condition of the product upon receiving the package.
    3. 3. If experiencing damage to the product, the buyer can contact MAPCLUB Customer Service.
    4. 4. The shipping claim fee is borne by the buyer for areas outside Jabodetabek, Bandung, and Surabaya.
    5. 5. The maximum coverage is up to the price of the product, for losses, damages, or theft due to accidents during the shipping and warranty period, which has been insured with Shipping Insurance and Product Damage Insurance.
    6. 6. The Certificate of Coverage (e-Certificate) will be sent by Insurance company to the buyer's registered email address in MAPCLUB membership. Please ensure that the email address is correct and active.
    7. 7. For further information and inquiries regarding Shipping Insurance and Product Damage Insurance, contact the insurance company by referring detail information email from the Insurance.

 

MAPCLUB is not responsible for losses and damages that occur during shipping, and if the purchase is not insured, a claim for replacement cannot be made.

12. GADGET PROTECTION

 

 

Terms & Conditions:

  • a. Protect the gadget and electronic products you purchase from MAPCLUB with Gadget & Electronic Protection
  • b. Benefits of protection: protect gadgets and electronic products from physical damage caused by falling, being knocked over, thrown, and coming into or getting wet from water.
  • c. The protection will automatically be cancelled if the purchased product is returned to the seller (MAPCLUB).
  • d. The Certificate of Coverage (e-Certificate) will be sent by Insurance Company to the email registered in the MAPCLUB membership. Please ensure that the email address is correct and active.
  • e. If there is a product exchange that causes the product description in the Certificate of Coverage (e-Certificate) to differ from the received product, the user must contact FUSE and correct the Certificate of Coverage (e-Certificate).
  • f. The provision of cashback is the right and prerogative of Insurance Company and its affiliates, and cannot be challenged.
  • g. For more information, member can contact Insurance provider from detail e-certificate.

 

 

13. "Lifestyle Protection" Life Insurance

 

"Lifestyle Protection" is a protection in the form of benefits against the risk of personal accident for MAPCLUB Members who purchase the insurance policy, in collaboration with PT Equity Life.

  1. a) Death benefit due to accident of Rp20,000,000
  2. b) Permanent disability or partial disability due to accident of Rp20,000,000
  3. c) Reimbursement of hospitalization expenses due to accident of Rp2,000,000

Scope of Protection:

The protected User (the Insured) dies due to an accident that occurs during the protection period.

 

 

Terms & Conditions:

  • a. Registration for protection (for the Insured) is only applicable to customers or MAPCLUB members who have registered and made a transaction. Registration for protection (for the Insured) cannot be directed to anyone other than customers or MAPCLUB members.
  • b. The minimum age limit for the protected user (Insured) is 17 to 59 years old (referring to the MAPCLUB membership rules). If you are under 17 years old, you must use our platform with the involvement and supervision of a parent or guardian.
  • c. The protection coverage period is 30 days from the completion of the transaction status.
  • d. Each Insured can only have a maximum of 3 (three) insurance memberships/Insurance Certificates during the same period or separately.
  • e. Each MAPCLUB member who purchases protection will receive proof of membership and policy activation through an e-certificate sent to the email address registered in the MAPCLUB account when the transaction status is stated as "Completed".
  • f. Protection that has been paid for by the customer or Insured cannot be cancelled or refunded.
  • g. All terms and claim decisions are determined by the Insurance Company (PT Equity Life Indonesia).
  • h. Protection cannot be extended and only applies for 30 days from the completion of the transaction status as stated in the proof of membership. Customers can make another protection purchase by making a new transaction.

14. Terms and Conditions of BNI MAPCLUB Card

 

BNI MAPCLUB Card is a credit card in collaboration between PT MAPCLUB Digital Asia (“MAPCLUB”) and PT Bank Negara Indonesia (Persero), Tbk. (“BNI”) and supported by Visa network.

This terms and condition is part of the Terms and Conditions of the MAPCLUB Website/Platform and the applicable terms for submitting and using BNI MAPCLUB Card which will apply as an agreement between you, us, and Bank BNI. Please read the terms and conditions carefully, thoroughly and in comprehensive. By submitting and/or using the BNI MAPCLUB Card, you have understood, accepted, agreed, comply to and given irrevocable or inalienable approval for all applicable provisions.

You hereby give your consent to MAPCLUB, if necessary, to obtain, collect, process, analyse, display, send, open, store, adjust, delete, manage and/or use your personal data required in BNI MAPCLUB Card application process to BNI, or to register you as a MAPCLUB Member (for those of you who are not yet registered as MAPCLUB Member). Without your consent, we will not publish or disclose information that we know or obtain, except when required by law and in accordance with applicable laws and regulations in Indonesia. If you apply for BNI MAPCLUB Card, you hereby state that:

  1. 1. Agree to follow any of the process of BNI MAPCLUB Card application in accordance with the system and terms applicable in MAPCLUB and BNI. Further terms can be checked in BNI MAPCLUB Card Guidebook here.
  2. 2. Comply with all requirements set by MAPCLUB and BNI when applying for and using BNI MAPCLUB Card.
  3. 3. Submit the complete, valid, and correct data, information, and documents.
  4. 4. Agree to give authorization and approval to MAPCLUB and/or BNI to do the necessary action in processing the application and issuing BNI MAPCLUB Card.
  5. 5. Understand and agree that any losses arising from your negligence, including but not limited to misuse of accounts, claims, summons, lawsuits, demands and/or other efforts filed by third parties, are not the responsibility of MAPCLUB. You hereby agree to release MAPCLUB from any losses and/or lawsuits that you may suffer due to this.
  6. 6. This terms and condition may be changed and/or updated from time to time, we recommend you to read carefully and check this Terms and Condition from time to time.

 

BNI MAPCLUB Card Benefits

 

Several extra benefits such as welcome rewards, double points, and free shipping are available for members who are BNI MAPCLUB cardholders. However, benefits may change depending on current promotions and conditions.

 

 

15. Force Majeure

We are not responsible for the fulfilment of the terms and conditions of this Platform, whether partially or in full, due to one or more events beyond our reasonable control.

 

If a force majeure event occurs, the Platform may not be accessible, experience disruptions, or be delayed in the delivery of products you have purchased. In the event of a delay in the delivery of products you have purchased due to a force majeure event, you will be given the option to postpone delivery or cancel your purchase and receive a refund in accordance with our applicable policies.

16. Trade-In

MAPCLUB provides a Trade-In feature to make it easier for members to sell old products and get discounts for purchasing new products. This Trade-In feature collaborates with Laku6, one of the leading trade-in service providers. Currently, the Trade-In feature is available for mobile phone products.

 

Criteria for Smartphones that can be traded:

The old device must function normally, including the screen, buttons, and charging port.

  • The device's IMEI must match the registered model.
  • The device is not locked by an account such as Google, Mi Account or iCloud.
  • Cellular network & Wi-Fi must be properly connected. The transaction will automatically fail if the cellular network & Wi-Fi on the old device cannot be read.
  • Specifically for tablets, only cellular tablets are accepted (Wifi Only Tablets are not accepted).
  • Severe damage (such as a badly cracked screen) can reduce the exchange value or make the device ineligible for trade-in.
  • Old devices that are completely off cannot be accepted at this time.
  • For devices with Fold and Flip models, the device must be able to open perfectly. If the device turns off when the device is half closed / partially closed, the Trade-in process cannot be continued.
  • For devices equipped with a Stylus Pen, the Buyer must also provide a Stylus Pen when making an exchange and the Stylus Pen must be appropriate & functioning properly.
  • The Buyer must provide a survey answer according to the condition of the old device objectively, the trade-in partner has the right to cancel the transaction if the old device given to the courier is not appropriate.

 

 

Assessment & Replacement Process:

  • Initial trade-in value estimation is done online through MAPCLUB by filling out a survey with the actual condition of the old device to be exchanged.
  • Buyers are required to provide survey answers according to the condition of the old device objectively.
  • The trade-in price listed on the platform is the estimated price of the old device.
  • The initial estimated price is used as a discount on the payment page on MAPCLUB.
  • The final price is determined after a physical inspection of the device by the logistics partner during the exchange or at the partner outlet.
  • User needs to add the price difference (top-up) if the final price is lower than the estimated price (survey price) at the beginning of the transaction.
  • If the user is unwilling to pay the difference in price from the value of the old device, the trade-in partner through MAPCLUB can cancel the trade-in transaction.

 

 

Data Security:

  • MAPCLUB and Trade-in Partners are not responsible for data loss that occurs after the factory reset process, SIM Card, and any claims related to data stored on the consumer's cellphone such as personal data, SMS, photos, songs, videos, and other data.
  • Members or buyers agree and voluntarily provide and fully authorize MAPCLUB to provide, forward, transfer, disclose information, personal data and / or relevant data to the trade-in partner in the form of: name, telephone number and address of members limited to the implementation of the Trade-in Program.
  • By using the Trade-in feature, members / buyers authorize MAPCLUB to store their information and / or data related to the use of trade-in feature on MAPCLUB.

 

 

Shipping and Exchange:

  • Members / Buyers are required to delete personal data and restore the device to factory settings before handing over the old device to the MAPCLUB Trade-in partner.
  • When exchanging a product with an old Device, the buyer must show a valid ID card to the courier implementing the exchange, as valid proof of the handover of the old device and the provision of new goods.
  • The buyer agrees that the exchange partner has the right to cancel the exchange transaction if the old device does not comply with the terms and conditions stated.
  • The buyer is required to accept the New Electronic Device submitted by the exchange partner. If the New Electronic Device has a manufacturing defect or other damage that is not caused by the Buyer or the exchange partner, the Buyer can complain directly to Customer Service via the Site / Application.
  • The exchange transaction cannot be cancelled after it has been declared successful at the handover of the old device.

 

 

Cancellation:

  • Members or Buyers cannot cancel trade-in transactions on the MAPCLUB.
  • Buyers agree that a cancellation fee will be charged if conditions are found that do not comply with the terms and conditions stated.
  • The cancellation fee mechanism is carried out by deducting directly from the payment funds that have been made by the Buyer. The fee is determined by the Trade-in partner and cancellations can be tiered based on the nominal price of the new goods purchased by the user.

 

17. Governing Law

These terms and conditions are governed and construed in accordance with the laws of the Republic of Indonesia. Except as otherwise provided by applicable law, any legal action, dispute, or claim arising out of or in connection with these terms and conditions shall be resolved exclusively through the District Court of Central Jakarta.

18. Amending, Modifying and Changing the Terms and Conditions

We reserve the right to revise, modify, add, change, or remove any part of these terms and conditions at any time and in any manner we choose, and we will post the revised terms and conditions on the Platform. By accessing and using the Platform after any such revisions, modifications, and/or changes, you are deemed to have accepted, understood, and agreed to such revisions, modifications, and/or changes. You are not permitted to alter or modify these terms and conditions.


 

 

19. Violations

If we detect any misuse, manipulation, violation, or unauthorized use of promotions, indications of fraud, or breach of these terms and conditions or applicable law, we reserve the right to take any necessary actions, including but not limited to:

 

  • a. Account deletion;
  • b. Limitation of account rights;
  • c. Suspension of account;
  • d. Cancellation of subsidies or cashback;
  • e. Cancellation of reward benefits;
  • f. Cancellation of promotions;
  • g. Cancellation of purchase transactions;
  • h. Holding of funds;
  • i. Reporting of criminal activity;
  • j. Legal action, including claims for damages and/or temporary or permanent injunctions, or filing a lawsuit for compensation in court.

20. Account Termination and Membership

Unless otherwise specified in these terms and conditions or by applicable law, these terms and conditions shall remain in effect and shall be binding upon you and us concerning any obligations that have not been fulfilled after the termination of your account and membership.
