The MAPCLUB Privacy Policy governs the use of personal information collected through the www.mapclub.com website, its subdomains, and/or the MAPCLUB Application (hereinafter referred to as the“Platform” or “MAPCLUB”). This policy is an expression of our commitment to respect and protect the data and privacy of users (hereinafter referred to as "You" or "Users'') of the Platform.

This Privacy Policy (together with the Terms of Conditions and other information displayed on the Platform) explains what types of information (including personal information) we collect, how we use this information, with whom we share it, and the choices you have regarding the collection, use, and disclosure of this information by us. This policy also outlines the steps we take to protect and secure the information we have obtained. The term "Personal Information" refers to information that can be used to identify a User.

By clicking "Register" or logging in and/or registering using any other method available on the Login and/or Register page on the Platform, Users represent and warrant that all personal information you provide is accurate and valid. Users acknowledge and agree that they have read, understood, and consented to the terms of this Privacy Policy, and therefore grant MAPCLUB the right to obtain, collect, process, display, transmit, open, store, modify, delete, manage, and/or use their Personal Information for the purposes outlined in this Privacy Policy.

1. Information We Collect

We collect Personal Information from Users to provide services that align with their preferences, to process purchase transactions, to manage MAPCLUB Points, and for other purposes that do not violate applicable laws and regulations in Indonesia. We may obtain Personal Information from various sources, including but not limited to when Users use the Platform, when Users contact or email us or communicate with us through social media, when Users participate in our events or promotions, as well as through our parent companies, subsidiaries, affiliates, business partners, and third parties.

When Users create an account or log in using any of the methods available on the Platform, we will collect personal information, including but not limited to Users' name, address, mobile number, email address, date of birth, gender, and other information that may be necessary for user identification. We may combine the data we obtain from the above sources with other data we already possess.

 

Additionally, we may automatically collect certain information, such as cookies and web beacons, when Users visit or use our Platform. "Cookies" are text files sent by a website to a visitor's computer or other internet-connected device to uniquely identify the browser or store information or settings in the browser. "Web beacons," also known as web bugs, pixel tags, or clear GIFs, are used to send information back to the server of the Platform. We may also use third-party web analytics tools that collect information about visitor traffic on our Platform.

We do not collect or store your personal credit card details or personal banking details, including but not limited to credit card expiry date, CVV code, SMS OTP code, or barcode applications, etc. ("Personal Banking Data") for payment processing or customer service purposes, without your consent. However, we offer a feature for storing Personal Banking Data to facilitate your transactions on MAPCLUB. Such storage is processed directly by PT Midtrans, an online payment gateway provider, which processes payments in accordance with applicable terms and policies.

To protect your sensitive Personal Banking Data related to payments on MAPCLUB, we implement encrypted digital identification technology. This ensures that your actual Personal Banking Data is not stored directly on our systems. Instead, your Personal Banking Data is encrypted into a unique, secure substitute data that cannot be used to conduct transactions without your legitimate authorization.

2. Use of Information We Collect

We may use the information about Users that we obtain to:

a. Register Users' membership on our Platform, and manage and maintain their accounts on our Platform.

b. Provide the products or services that Users request.

c. Process, validate, confirm, verify, deliver, and track Users' account and transaction activities (including processing payment card transactions, arranging shipping, handling returns or refunds, and contacting Users regarding their orders, including contacting them by phone).

d. We record Users' purchase history on our Platform and/or with participating and cooperating retailers.

e. We respond to Users' questions and comments and provide appropriate customer service to them.

f. We inform Users about our products, services, offers, events, and promotions, as well as offer products and services we believe may be of interest to Users, including but not limited to promoting and processing contests and/or sweepstakes, giving gifts, and providing relevant advertisements and content related to MAPCLUB services.

g. We manage Users' participation in our other events, contests, and promotions.

h. Contacting Users to assist and/or complete transaction processes and/or resolve issues related to purchases and/or use of the Platform and/or use of MAPCLUB Points, or to deliver other notifications related to User Personal Information protection.

i. Allowing Users to communicate with us through blogs, social media, and other interactive means.

j. Publishing Users' testimonials about the Platform, including on our website, blog, and social media (if we decide to publish your testimonial, we will only include Users' first name, last initial, city, and country).

k. Customizing our products and services to match Users' personal interests when visitors use our website, application, and social media assets.

l. Operating, evaluating, and improving our business as well as the products and services we offer.

m. Analyzing and enhancing our communication and marketing strategies (including identifying whether emails sent to Users have been received and read).

n. Analyzing trends and visitor statistics related to the use of our website, mobile application, and social media assets, as well as purchases made by visitors on our Platform, to enhance User Personal Information protection and security and improve features on our Platform.

o. Providing prevention and protection against fraud, unauthorized transactions, claims, and other liabilities, as well as managing the emergence of risks, including identifying any hacking attempts and unauthorized users.

p. Complying with orders to disclose User Personal Information from authorized authorities for law enforcement or fulfilment of legal requirements and obligations, including but not limited to legal proceedings between Users and MAPCLUB or suspicions of criminal activities such as fraud or data theft.

q. Facilitating mergers, asset sales, company consolidations or restructuring, financing, or acquisitions involving MAPCLUB.

r. Enforcing our Platform's Terms of Use and Terms and Conditions.

s. Complying with applicable laws, industry standards, and our policies.

In addition to the use of data as described above, we may also use information collected through cookies and other automated means to uniquely identify Users' electronic shopping carts on our Platform and enable Users to access their previously created shopping carts. We may also use cookies to identify and validate visitors.

We may combine the information we obtain with publicly available information and information we receive from our parent company, affiliates, subsidiaries, business partners, and other third parties.

We may use this combined information to enhance and personalize Users' membership and shopping experience with us, inform Users about our products, services, and events that may be of interest to them, and for other promotional purposes and other purposes as needed from time to time by us. We may also use information about Users that we obtain by providing specific information when collecting data.

 

3. Device Access

To fully utilize our Platform, Users may be prompted to enable certain features on their mobile device, including access to their contact information in their address book, location, device identifiers/advertisements, push notifications, and browsing behaviour.

Users will be given the option to allow or not allow us to access their mobile devices. Accessing Users' mobile devices will assist us in facilitating their use of our Platform, including improving the user experience and providing additional functionality based on the access they grant. We may not be able to provide certain features on our Platform if Users do not choose to enable the features on their mobile device or grant us access to their mobile device.

Please note that we will not collect or store any information from Users' mobile devices. The access feature for Users' mobile devices is only intended to enhance the User experience and will not be collected or stored by us. Please also note that Users always have the option to not enable or allow us to access their mobile devices. If Users have already enabled or allowed us to access their mobile devices and later change their mind about it, they can disable or revoke access to their mobile devices at any time.

By using our Platform, Users agree and acknowledge that we are not responsible for any names, phone numbers, or personal data contained in the address book that they share with us at their discretion for any purpose and they will be responsible for any requests, claims, damages from third parties that may arise under the Personal Data Protection Law or other related regulations. Furthermore, Users agree, accept, and acknowledge that we have the right to seek compensation from Users for any losses incurred or affected by them.

Please note that we will not publish or disclose any information that we know or obtain (if any) without Users' consent if Users enable and/or allow us to access their mobile device, except as required by law and in accordance with applicable regulations in Indonesia, with prior notice to the Users.

4. Online Advertising

On our Platform, we may collect information about Users' online activities to advertise products and services that align with their interests. Users may see specific ads on our Platform, which may direct them to pages on our Platform or external pages outside of our Platform.

In addition, you may also see ads about our Platform on other websites or apps because we participate in an ad network. The ad network allows us to target ads to Users through demographic, behavioural, and contextual methods. The network tracks Users' online activities over time by collecting information automatically, including through the use of cookies, server logs, web beacons, and other methods. The network uses this information to display ads for MAPCLUB and our business partners that are tailored to Users' interests.

Information collected by our ad network provider includes information about Users' visits to websites or mobile apps that are part of our ad network, such as pages or ads they have visited, and activities they have performed on the site and/or app. Data collection and ad targeting may occur on our Platform as well as on third-party websites that are part of the ad network. This process also helps us track the effectiveness of our marketing activities.

5. The Information We Share

We do not sell or disclose Users' Personal Information except as described in this Privacy Policy. We may share Personal Information that we collect with our parent companies, subsidiaries, affiliates, business partners, advertising vendors and their members, and other third parties for the purposes described in this Privacy Policy, based on Users' consent, which they have given when they use and/or register to become a User on our Platform, including to provide information about our products and services, offers, events and promotions that we consider interesting for them.

We may also share Personal Information with service providers who work on our behalf. We will not allow these service providers to use or disclose Personal Information except as necessary to perform services on our behalf or as required by law.

6. Users’ Choices

We offer Users certain choices about the information we collect from them, how we use and disclose that information, and how we communicate with them. Users can also change some of their Personal Information or withdraw their consent to our processing of their Personal Information at any time. If Users have any concerns about how we process their Personal Information, they can contact us at any time.

We will implement Users' choices as soon as possible. In some cases, withdrawing their consent to the use or disclosure of their Personal Information from our Platform may result in Users' inability to use, benefit from, or access certain features or offers on our Platform, either partially or entirely.

7. Access and Correction

Users can obtain a copy of their Personal Information that we have collected, update or correct it, or correct any errors in it using the account they have created on our Platform. Additionally, if Users believe that the Personal Information we have about them is inaccurate, they can request that we correct or change it by contacting us as described in the "Contact Us" section of this Privacy Policy. If we deny Users access requests, we will provide them with the reason for the denial.

We will only process requests to obtain a copy of or to update or correct Users' Personal Information if the User has provided sufficient proof of identity to access, update or correct the information.

MAPCLUB may deny requests to access, make a copy of, update or correct, partially or entirely, the Personal Information that MAPCLUB has or controls if required by applicable law, including if the request for access, copying, or updating or correcting is deemed irrelevant or is considered improper or invalid by MAPCLUB.

8. Links to Other Websites

Our Platform may contain links to other websites or pages for Users' convenience and as additional information for them. Some of these websites may be operated by companies that are not affiliated with us. Sites related to us may have their own privacy policies, which Users should review if they visit those sites.

We are not responsible for the content of any websites or pages that are not affiliated with us, the use of those sites, or the privacy practices of those sites.

9. How We Protect Personal Information

We use administrative, technical, and physical safeguards designed to help us protect the Personal Information that we collect from unintended destruction, loss, alteration, access, disclosure, or unauthorized use or misuse. For example, we use encryption such as Secure Sockets Layer (SSL) to protect information transmitted to us. However, no electronic transfer of information is completely secure. We cannot guarantee that our security measures will prevent Personal Information from being improperly accessed, destroyed, or altered, or that our measures will always be effective.

For additional protection, Users should protect their MAPCLUB username, account password, and personal banking information, and not share this information with anyone. Users should also log out of their account and close their browser window when they are finished visiting our Platform. Please note that we will never ask for their username or password through any means. We will also never ask for Users' personal banking information, except for the personal banking information required to be filled in during the payment process at MAPCLUB.

We are not responsible for unauthorized use by third parties that is beyond our control. Transactions that occur as a result of Users' negligence, resulting in the disclosure of their Personal Information or personal banking information to third parties, are their sole responsibility.

Users' Personal Information may also be stored or processed outside of the User's country by parties working on behalf of MAPCLUB, or by third-party service providers, vendors, suppliers, partners, contractors, or affiliates of MAPCLUB. In such cases, MAPCLUB will ensure that Personal Information is protected in accordance with MAPCLUB's Privacy Policy commitments.

10. Age Limitations

The use of the Platform, including membership in MAPCLUB, earning MAPCLUB Points, and purchasing products on the Platform, is not intended for children under 17. If Users are under 17, they must use our Platform with the involvement and supervision of a parent or guardian.

11. Changes to Privacy Policy

This Privacy Policy may be changed and updated from time to time without prior notice to Users. We will post a notification on our Platform if significant changes are made to the Privacy Policy and explain when the last change was made in the notice.

We recommend that Users read this Privacy Policy from time to time to stay informed of any changes made to our Platform's Privacy Policy. By continuing to access and use our Platform, Users are considered to have accepted any changes made to this Privacy Policy.

12. Conditions of Acceptance and Stopping Promotional Emails

When Users sign up to receive our newsletter, they will have the option to stop receiving our regular service updates, including:

a. Notifications of new products, features, improvements, special offers, contests, events, and special promotions via email.

b. Direct mail notifications of new products, features, improvements, special offers, contests, events, and special promotions.

If Users wish to stop receiving these updates, they may do so at any time without incurring any additional charges. All emails we send include an automatic link to unsubscribe, allowing Users to stop receiving promotional emails.

 

13. Account Deletion Policy

Users can request to delete their Account (including personal data such as name, address, email, and mobile number) including transactions and membership in MAPCLUB.

Please note that upon deleting their Account, all related data, including account, transaction, and membership data in MAPCLUB will also be permanently deleted and cannot be recovered. The following data will be deleted:
1. Personal data
2. Reward Points
3. Store credit balance
4. Transaction history

Notes:

a. Users can create a new account with the same data. However, all transaction history, reward Points, and store credit balances on their old account cannot be returned and transferred to their new account.

b. MAPCLUB will only retain records of data from deleted accounts for sales counting, product availability, and financial audit purposes.
